The law is the instrument of protecting the values held dear by the societyand the constitution is meant to aid this by instituting social change and reforms through values such as social justice,equality,human rights,rule of law,freedom and democracy.
Pursuant to article 244(c) of the constitution, the National Police Service is enjoined to comply with costitutional standards of human rights and fundamental freedom. In conformance with article 49, it spells out the rights of arrested persons.
The images that surfaced online recently showing police whipping men lying on the ground in Yumbis Garrisa county have drawn criticism and castigation from human rights groups. The incident came after police officers on a security mission were ambushed in the area and at least one killed ,four injured and police vehicles destroyed. In a bid to end terrorism, police officers should not contravene the provisions of the constitution on rights of arrested persons ,human rights and fundamental freedom. How will the security agencies expect the local people to work with them if they torture people in that manner? If the police will use such ruthless methods ,then what will stop the victims from harbouring resentment against their goverment and having a soft spot for terrorists? Even though the IG and IPOA have ordered investigations into photographs circulating on social media, it is clear that our security woes stem largely on selective application of justice and force on certain people. Investigations should be conducted expeditiously and those found culpable, should face disciplinary and legal action. Kenyans are watching.
