Uhuru Kenyatta hangs on technicality to delay call on 13th Parliament

President Uhuru Kenyatta is hanging on a technicality to delay summoning first sitting of the 13th Parliament.

Until yesterday, the Independent Electoral and Boundaries Commission was yet to publish list of MPs to be nominated in the Kenya Gazette as required by the law, granting the President leeway to hold back. Section 36 of the Elections Act obligates the IEBC to designate, from each qualifying list, the party representatives on the basis of proportional representation within 30 days after declaration of the election results.

Vihiga Senator-elect Godfrey Osotsi and Makueni Governor Mutula Kilonzo Jnr said yesterday the Elections Act provides that the first sitting of Parliament can only convene after names of members representing special interest groups are published in the Kenya Gazette. While the President is still within the timelines provided by the Constitution, he has received criticism from Kenya Kwanza Alliance members, who are claiming political mischief.
