Move to decongest courts a very good idea

Kenya: The move by Chief Justice Willy Mutunga to open 14 new High Courts country wide is an honorable action.

In the recent past, the judicial system has been on the spotlight for being so slow, corrupt and incompetent in their duty of justice provision. This move therefore comes in handy because it will help in speeding up the system and also reduce corruption as new blood is being injected in the system.

The new judges posted in the new High Courts are expected to start reporting to work on September 1, 2015. They are expected to help in the court decongestion process as it is a way of ensuring fair justice to Kenyans.

There are reports that there are over 16,000 unattended cases in 10 stations and therefore the new judges are expected to attend to them promptly.

The New High courts will also bring justice and judicial services close to citizens in marginalized areas; this is because the courts have been opened in Marsabit, West Pokot, Kajiado and Taita- Taveta. The residents in these areas have been travelling for long distances just to access a high court or any other judicial facility.

It a constitutional right for everyone to get timely and fair justice as stated in Article 159 0f the constitution. But this provision has always been violated as justice is always delayed due to inadequate courts and judges. The opening of the new High Courts by the Chief Justice Willy Mutunga should therefore see an end to delay of justice because” justice delayed is justice denied”.
