Nairobi Governor Evans Kidero now wants the court not to freeze his bank accounts after allegations he stole Sh650 million from Mumias Sugar Company.
Through lawyer Tom Ojienda, Kidero said freezing his accounts would deny him assets and contravene his constitutional rights as he would be presumed guilty of the allegations of theft before being heard.
Last week, city businessman Jacob Juma moved to court to have the governor charged with alleged theft. He wants the former Mumias Sugar managing director charged with engaging in fraudulent and scandalous financial accounting at the company.
According to the businessman, the offences should also include insider trading and any other offence committed while at the company.
Juma further wants the court to declare Kidero unfit to hold public office, claiming he was responsible for Mumias Sugar Company’s downfall.
Kidero denies the allegations, saying the petitioner avers the money belongs to Mumias Sugar Company without any evidence.
Kidero alleges the petitioner is acting as an agent of undisclosed sources by engaging in a fishing expedition where the same matter is being placed before several courts but drafted in different pleadings.
Kidero said for such a matter to be certified as raising a substantial question of law, it must involve violation of fundamental right or freedom, inconsistency with or contravention of the Constitution or exercising power in a manner inconsistent with the Constitution.
