A case seeking to have parliament dissolved has been forwarded to Chief Justice Evan Gicheru for hearing and further directions.
The case will be mentioned in the course of the week after the Mombasa High court certified it as urgent, saying the gravity of the issue required two or more judges to listen to the application.
The court had ruled that the suit, filed by Mr Joseph Ochwangi Onyiego was grave and raised issues of great national importance.
Mombasa High court judge justice Leonard Njagi, while delivering the ruling noted that the fears raised by the voter were genuine and deep-rooted following a recent national experience arising from the aftermath of the 2007 elections.
Mr Onyiego, through his lawyers Gikandi Ngibuini and Justus Munyithya, has sued the Attorney General (AG) and the speaker of parliament, seeking orders that there be new elections, following the Electoral Commission of Kenya (ECK) disbandment.
The judge also noted that the concerns raised had substance and were well founded.
"The nation of Kenya is going through a turbulent phase of fear of the unknown, dreading what would happen if any parliamentary or presidential elections were to be held today," said Justice Njagi.
