Four face murder charges after clashes in Tana River County

Four herdsmen injured in Sunday’s tribal clashes between Somali and Orma pastoralists in Galole constituency, Tana River County, are now facing murder charges.

Mohamed Kanchora, Saladh Guyo, Haji Mohamed and Omar Salad Guyo appeared before Tana River Senior Magistrate Kiprono Matutu but did not plead after the prosecution applied for additional time for police to complete investigations.

State counsel Antony Karanja said police require time to contact witnesses, most of who are pastoralists. Mr Karanja said police were unable to conduct investigations within 24 hours because witnesses were being traced.

He pleaded for more time to gather more information on the incident.

Earlier, area Divisional Criminal Investigation Officer Calisto Mauko said the accused were arrested on August 8 at Hola District Hospital where they had been admitted.

Compelling reasons

In his ruling, Mr Matutu said there are compelling reasons to detain the suspects at Hola Police Station, and directed that they be presented to the High Court in Malindi on August 24.

He warned that the four could be acquitted if the State fails to present witnesses.

Meanwhile, in the same court, a nurse at Hola District Hospital who was charged with posting an offensive message on his Facebook account was acquitted due to insufficient evidence.

Gwiyo Kwaraa Damon, who was accompanied by hundreds of medical staff, was accused of creating needless anxiety among local communities.

Mr Damon was arrested on August 6 at Hola Hospital and was detained at Hola Police Station until yesterday when he was presented in court.

He was represented by Danson Mungatana and other lawyers.
