Supreme court made the right decision

The decision by Supreme Court to dismiss Deputy Chief Justice Kalpana Rawal and Justice Philip Tunoi appeal case concerning their retirement age is laudable. This is the social justice we need in our public offices especially the judiciary.

The two have been battling with the retirement age issues at the corridors of Justice without success as the Court of Appeal dismissed their case. For one, Kenya has a lot of qualified judges who can take up their positions without any haste. Kenya is not a graveyard of beautiful constitution. We have constitution in place that should be implemented when necessary. I find it more archaic to have cases that relate to matters outlawed by the 2010 constitution.

It is also shocking and surprising that those whom Kenyans have entrusted as champions of justice are the same individuals who want to curtail it at the expense of their personal gains.

The factions in Supreme Court also raise a number of questions. Do judges of Supreme Court uphold professionalism in the course of duty? It is bits on logic that disunity is alive and well. This also puts to question the integrity of our judges.

If there is a judge that deserves salutation for a job well done is the Chief Justice Willy Mutunga, who retired yesterday. As he bids goodbye Supreme Court, let the new Chief Justice to be appointed perform his duty according to the constitution but not to be a darling social injustice, corruption and incompetent.
