Court rejects firm’s bid to transfer case

An attempt by a company associated with former nominated MP Mark Too to have a Sh100 million Eldoret land case heard in Nairobi has failed.

Mr Too, through his company Charter House Investment Limited, had moved to a Nairobi court accusing three individuals of illegally occupying a parcel of land in Eldoret town that belonged to the organisation. The former MP has sued Moses Songok, John Kipchumba and John Songok of illegally taking over land registration number block 12/424 in Eldoret municipality. The case was before Principal Magistrate Peter Ndwiga at Nairobi Law Courts.

The magistrate ruled the matter be transferred to Eldoret following an application by lawyer Paul Gicheru, representing the first defendant (Moses). Gicheru sought to have the case transferred back to Eldoret arguing the property in dispute, the complainant and the defendants are in the town.  Gicheru submitted that a case should not be instituted to favour the complainant and appealed to the magistrate to have the matter transferred to Eldoret.
