Attribution & Brand Use Requirements

Where permission is granted, and content is licensed for use, attribution is mandatory and must appear clearly and prominently as follows:

Logo Use Guidelines

• The official logo of The Standard Group PLC or its relevant brand must be used.
• The logo must not be altered in any way, including but not limited to:
  • Changes to colour, shape, proportions, orientation, or typography
  • Cropping, stretching, distortion, animation, or visual effects
  • Removal of brand elements or substitution with unofficial logos
• The logo must appear in its approved brand colour(s) and remain clearly visible, legible, and unobstructed at all times.
• The logo must not be placed on backgrounds that reduce contrast, visibility, or brand clarity.

Legal Framework: Kenya Copyright Act

This website and its users are governed by the Copyright Act, Chapter 130 of the Laws of Kenya, which provides legal protection for original works fixed in any tangible form. The Act grants creators and rights holders exclusive rights to control the use, reproduction, distribution, communication, adaptation, and commercial exploitation of their works.

Under the Act, copyright protection applies to, but is not limited to, the following categories:

• Literary works -- including news articles, investigative reports, opinion pieces, features, interviews, scripts, headlines, databases, and other written or textual content.
• Artistic works -- including photographs, illustrations, infographics, graphics, cartoons, artwork, layouts, and visual designs.
• Audio-visual works -- including video news reports, documentaries, filmed interviews, broadcasts, and other moving image content.
• Sound recordings and broadcasts -- including podcasts, audio interviews, radio segments, live streams, and recorded broadcasts.

Copyright under Kenyan law arises automatically upon creation of the work and fixation in a tangible or digital form. No formal registration, notice, or publication is required for copyright to subsist. All rights not expressly granted in writing remain reserved to the copyright owner.

Exceptions & Limitations

The Copyright Act (Cap. 130) provides limited statutory exceptions, commonly referred to as fair dealing, which allow restricted use of copyrighted works without prior permission under specific circumstances. These include use for:

• Research or private study
• Criticism or review
• Reporting of current events
• Educational or instructional purposes

Such use must be fair, proportionate, and accompanied by proper acknowledgement of the source and author, where practicable.

These exceptions are narrowly defined and do not permit:

• Reproduction of full articles, images, videos, or audio works
• Systematic copying or archiving
• Commercial exploitation or monetisation
• Republishing content on websites, social media platforms, or broadcast channels

The Act also allows limited copying for personal and non-commercial private use, provided the use does not conflict with the normal exploitation of the work or unreasonably prejudice the legitimate interests of the rights holder.
