A businessman has dismissed claims that he fraudulently acquired prime property in Nairobi.
Murktar Saman told a Kiambu court that he bought the land from the government after its 99-year old lease expired and received a title deed.
“I was granted the title deed legally contrary to allegations leveled against me. My lease was also renewed after its expiry,” Saman said.
The complainant, Pius Ngugi, had told Kiambu magistrate Bryan Khaemba that Saman acquired the one-acre in Eldama Ravine Road in Westlands illegally.
Ngugi claimed he bought the land from a foreigner, Hellen Fear, in 1974 before she relocated abroad. He was given the land papers which he presumed were original.
He alleged that the land was his and that the Land Ministry delayed to transfer ownership, a loophole Saman used to acquire it illegally.
Ngugi, who had no documents, told the court that his brother, who is mentally sick, lost the titles and transfer papers after the property purchase.
He said he reported the matter to a police station which he could not recall.
He did not have the OB reference number recording his report. The hearing is set for September 26.
