Twenty-four videos and audio recordings implicating former Maasai Mara Vice-Chancellor (VC) Prof Mary Walingo in Sh177 million corruption case, will be used as evidence.
Saturday, Nakuru Chief Magistrate Bildad Ochieng allowed the prosecution to produce the recordings by former Chief Finance Officer Spenser Sankale.
Mr Ochieng ruled that the evidence was legally obtained by Sankale.
"The witness was legally in the course of his work when he recorded the incidences," ruled Ochieng.
He noted that Sankale made the electronic recordings himself and he was having control over the computer used, meeting the threshold of the evidence act.
The court also noted that the prosecution was on course to obtain a certificate of the recordings as per the law.
"The prosecution is directed to provide a certificate for the recordings when needed," said Ochieng.
"The contention that the audio video recording was obtained illegally does not hold any water given that the same was made by the witness in the ordinary course of his work," he Ochieng.
The court ruled in an application by Prosecutor Terry Kahoro who said the recordings detailed several times Prof Walingo.
