The Council of Governors (CoG) is planning to sue the Government over the Sh280 billion belonging to the counties but is still with Treasury.

Speaking in Timau when he commissioned the "Simon" dispensary, CoG Chairman Peter Munya said all governors were in agreement that it was prudent to seek legal redress.

"We have been asking Treasury to release our funds to enable us perform our functions, but they have refused, leaving us with no option but to go to court," Mr Munya said. The CoG Boss said counties need the funds to continue with pending projects. He said the council has identified a legal team that includes lawyer Paul Muite to act on behalf of the counties.

"Counties are struggling financially and are unable to fulfill some of the election pledges," the Meru Governor said.

He said counties were facing numerous challenges and want the court to compel the Government to release the much awaited funds.

"It’s our constitutional right to have our rightful share of resources but the national government is not keen to disburse the funds for all devolved functions," he said.

Munya said the devolved units could have achieved a lot by now, but insufficient funds has bogged down their operations.

"We do not have a problem with the national government, but we also want our rights to development funds," he said.
