Senators welcome court verdict on Martin Wambora

Senators have welcomed the High Court decision to uphold the impeachment of Embu Governor Martin Wambora, saying the Judiciary should not interfere with operations of other arms of Government.

The lawmakers emphasised that impeachment is a political process and therefore the courts should not issue orders as this interferes with separation of powers.

Led by Speaker Ekwee Ethuro, the senators warned that if courts overturn the Senate’s pronouncements, it will give the county bosses a free hand to avoid being held accountable.

“I am happy with the ruling on the second impeachment process, which was very flawless. It is sad when institutions created to promote transparency and accountability can become epitome of impunity, giving refuge to leaders who have lost the people’s good will,” he said.

Ethuro continued: “As a result of this ruling, suspected perpetrators of corruption will not go scot-free.”

Court battles

Minority Leader Moses Wetang’ula (Bungoma), senators Kipchumba Murkomen (Elgeyo/Marakwet), Mutahi Kagwe (Nyeri), Charles Keter (Kericho), Mutula Kilonzo Junior (Makueni), Boni Khalwale (Kakamega), Hassan Omar (Mombasa) said the Senate was vindicated.

“Wambora has continued to be in office, merely on technicalities and court orders. I am happy the court upheld the impeachment. It has at least crystallised the Senates’s profile and mandate,” he said.

Kilonzo Junior added: “The court has now re-affirmed the Senate’s position and the constitutionality of financial prudence.”

On February 12 this year, two days to the first anniversary of Wambora’s first impeachment, judges Richard Mwongo, George Odunga and Weldon Korir upheld his impeachment and once again, he begins another cycle of court battles.

On January 22 last year, the Embu County Assembly initiated the process to remove the governor from office on grounds of gross violation of the Constitution, public finance and procurement laws.
