MP to know his fate before end of this month

Jomvu MP Bady Twalib Bady will know on September 25 whether or not there will be a by-election in his constituency following a petition against him.

Justice Vincent Odunga, who heard the petition filed by Jomvu parliamentary race loser Seif Kajembe, said this after the parties involved completed their submissions.

Bady asked the judge to dismiss the petition on grounds that the petitioner had not brought evidence to warrant nullification of his election.

In response, Kajembe urged the court to nullify the election on grounds that he had produced enough evidence to prove there were malpractices during the election.

Kajembe’s lawyer Kithi Ngombo also asked the court to nullify Bady’s election because the Independent Electoral and Boundaries Commission (IEBC) had admitted that Kajembe won the election.

But in a quick rejoinder, IEBC lawyer Jeremy Okonjo asked the court not to rely on what was contained in their affidavit, particularly the last paragraph, which he said had a typographical error.
