The courts in Mombasa released Ikrima Mohamed Shosi who had been arrested and detained over terror related charges after the police failed to produce evidence linking him to terror charges.
Soshi is a brother to Ismael Shosi a terror suspect on the police most wanted list for killing a National Intelligence Service officer NIS Hashim Omar last year in July
Police said that Soshi was arrested at Casablanca day and night club at 3 am.
However, yesterday Senior Principal Magistrate Richard Odenyo said that the police had failed to produce any evidence linking Soshi to terror charges and that the charges pressed against him were different from what police had sworn in the affidavit.
Ikrima was charged with being found at a place which persons resort for the purpose of sniffing, injecting, inhaling narcotic drugs and psychotropic substances.
The charge sheet read that on 3 June 2015 at Kidogo area of Mwenda Tayariin Mombasa County jointly with others already before court was found at a place where narcotic drugs were being used.
“I dismiss the charges pressed against the accused because the charges pressed are different from what the police introduced in their affidavit,” said Odenyo.
The family of the accused was all smiles as they left the courts after realising their son who had been in Shimo La Tewa was walking free.
Soshi was arrested by police in Mombasa on June 7 2016 for being a suspected member of the outlawed terrorist group Al-Shabaab.
He was accused to be aiding and harbouring members of the Al-Shabaab group, planning explosive attacks in Mombasa County and eliminating police officers.
Appearing before Principal Magistrate Nicholus Njagi in January 8 Ikrima said that he was innocent and was not involved in any of the alleged terror activities.
“Am innocent and not involved in any of the activities alleged by the prosecution, but it is okay if they want to detain me for 15 days to investigate,” insisted Shosi who seemed agitated and sweating a lot while smiling at the cameras in court.
“No one has charged you of being an Al-Shabaab, this are allegations and police want 15 days to investigate into the matter, after which they will tell us if it is true or not you are involved into the terror activities,” explained Njagi to the Shosi who insisted he was innocent.
Njagi then ordered police proceed with their investigations and present a report on the set date to determine the case and if they required more time to investigate, they would be granted after requesting.

The officer said that Ikrima has been harboring Al-Shabaab terrorists in his house within Guraya area where he has been organising to have explosive attacks within Mombasa County and eliminating police officers.
“I need to interrogate the respondent, establish his motive, analyse his mobile phones, record statements from relevant witnesses and any other source of information that may assist me in my investigations,” said the police officer.
Shosi had been the sixth high profile terror suspect to be arrested by police this year in a police drag net that sought to break and eliminate the Al-Shabaab terror cells.
On January 7 this year a Maseno University student who converted into Islam and suspected to be a member of the Al-Shabbab terror group was sentenced to 20 years in prison for propagating Radicalideas.
Samuel Wanjala Wabwile alias Salim Muhamud Wabwile was convicted for radicalizing six pupils from Liwatoni Primary.
