Samuel Wahome vs Kahama Group of Hotels (K1 Klubhouse)

 Wahome Samuel has lodged a complaint against Kahama Group of Hotels

Dear Nairobian Defender,

I was working with Kahama Group of Hotels, in particular Klub House 1, in Parklands as a waiter, for the last 15 years. In June this year, I was dismissed without any payment after coming from attending the graduation of one of my sons.

I was only paid Sh20,000 despite being fired without the notice of two months by Human Resource Manager saying it was for pending leave of 14 days, yet I have not even gone for leave, since the company does not offer leaves.

I just want to be paid the dues for the years I have worked with them, that is Sh15,000 multiplied by 15 years, which adds up to Sh225,000 according to labour laws, which stipulates that I be paid half of my salary, times the number of years I have worked, so long as I am not guilty of theft or had any leave.

I need that money so that I can start my own business and move on with life.

Steps taken by The Nairobian Defender

The Defender contacted Kahama Group of Hotels and we secured a meeting with the Human Resource Director, Mrs Christine Gatheru. The meeting was held on Friday last week and the hotel has committed to see the matter resolved.

Let us know if you would like us to accompany you for a meeting with the hotel. Meanwhile, please pay the hotel a visit and let’s see how it goes.

Below is the hotel’s response.

Dear Nairobian Defender,

We would like to thank you for bringing up this matter with us. Samuel Wahome was our staff and in May 2015, we separated and he was paid his final dues which he duly signed for.

We would appreciate it if he has any further claims to come to the office since he never complained nor have we heard from him ever since to clear this matter.

This is what Samuel had to say after the meeting:

“I went to see the HR manager by the name Christine after she told you to tell me to go see her. After I got there she told me the company doesn’t owe me any payment because they paid NSSF charges. I still feel it’s being unfair to me. I was told to go back on 13th October 2015 to know about my pending leave. I am grateful for your continued help and advice accorded so far. Thanks so much as I continue looking forward to your assistance.”
