Wataalam hao pia wanagusia kuwa huenda ile kesi inayowakabili washukiwa sita wa machafuko ya baada ya katika mahakama ya ICC ilichangia katika uteuzi huo.Munira Muhammad anaripoti kuwa iwapo Rais Kibaki na waziri mkuu Raila Odinga walijadiliana au la kuhusiana na uteuzi huo, tayari mzozo huo umeibua taharuki na pia kurejesha nyuma gurudumu la mageuzi katika idara ya mahakama ambayo wakenya wamepigania kwa muda wa miaka mingi.
