Kanye West in legal row after missing presidential election filing deadline by seconds

Kanye West's bid to be president of the United States of America has hit another roadblock. The rapper, 43, who is hoping to be elected to sit in the Oval Office, is taking legal action to make sure he is a candidate for the presidential election in Wisconsin after officials ruled he missed the filing deadline. In the swing state of Wisconsin, the hitmaker missed the 5 pm filing deadline on 4 August by 14 seconds, according to the Milwaukee Journal Sentinel. In retaliation Kanye then filed a legal complaint claiming that state law "does not distinguish between minutes and seconds" and so he should be on the ballot on Monday.

"For the average observer, arriving before 5:01 p.m. is arriving 'not later' than 5 p.m.," his election lawyer Michael Curran wrote in the filing. "The phrase 'not later' is particularly instructive in that it indicates the presumption that the seconds from 5:00:00 to 5:00:59 are inclusive to 5 p.m. As the statute states '5 p.m.,' for something to be filed later than ‘ 5 p.m.' it would have to be filed at 5:01 p.m."

His legal representative also claimed that Kanye's team were delayed in their filing by state election officials, who allegedly locked their agency's door. The filing was made in response to two challenges on the husband of Kim Kardashian's nomination papers after the submission was late and it is claimed that some of the signatures were phony. Kanye submitted 2,400 signatures - putting him above the threshold of 2,000 needed to get on the ballot - but the documents included incorrect addresses and false names - including Disney cartoon Mickey Mouse. Six individuals have also filed affidavits alleging they were tricked into putting their names on Kanye's nomination papers.

The complaints and West's filing will be reviewed by Wisconsin Elections Commission staffers, who will make a recommendation to the state's bipartisan elections board on whether he should be on the presidential ballot in November. It comes after Kanye was struck off the list of ballot options in his native state of Illinois following a dispute over signatures on his ballot application. While rumours that the star is only in the race to damage Joe Biden’s campaign have drawn scrutiny and speculation. However, the Jesus Walks rapper himself has insisted he wants to go all the way to the White House, tweeting last week: “The goal is to win.”
