MPs wife ordered to pay accident victim Sh60,000 a month, pending hearing of appeal filed

Nakuru Town East MP David Gikaria's wife has been ordered to pay an accident victim Sh60,000 every month, pending hearing and determination of a court case.

Justice Janet Mulwa issued the orders following an appeal by Violet Nzisa, the MP's wife, against a ruling by a lower court that she be paying Sh100,000 monthly to Martha Onganga until she settles a Sh738,721 award.

Nzisa was ordered to pay the amount on October 13, 2017 after she was found guilty of injuring Ms Onganga, a police officer, in 2016 by hitting her with a car.

At the time of the accident, the officer was on her way to Kaptembwo Police Station on a boda boda. After the accident, she was admitted to Kijabe Hospital for five months.

In a suit against the MP's wife, the officer prayed for compensation on general damages, future medical expenses and any other relief the court could deem fit. She sustained a spinal injury.

Nzisa committed to be paying the Sh100,000 monthly starting June last year but failed. A warrant of her arrest was issued.

As a result, Nzisa was arrested in October last year. She told the court she was not in a position to pay the Sh100,000 as she had pledged and that she could only raise Sh20,000.

In her appeal, through lawyer Pascal Mbeche, she wants the court to stay orders directing her to pay the Sh100,000 a month.

Lawyer Magata Owen, who represented the officer, opposed the application. “If they are to pay Sh20,000 each month, it will take many months to clear the sum and would be unfair to my client,” said Owen.
