Kibaki's property dispute court case resumes

A dispute between a Nyeri property firm Mathingira Wholesalers against retired President Mwai Kibaki, his brother and four elderly men resumes today.

In the suit, dating back to 2008, the firm claims the building’s land title was still in the name of the six men who founded the property firm in the 70s. The building in question houses a leading entertainment joint and rental houses.

Senior counsel Gibson Kamau Kuria, who is representing Kibaki and the other respondents, will be cross-examining witness Sammy Maina, who wants the contentious building handed over to the firm’s shareholders and deregistered from the company’s founders.

“The building and the firm, Mathingira Wholesalers, are inseparable because it is the only asset that we own as shareholders,” Maina said.

He added: “I have been receiving my dividends which accrue from the building’s rents until 2008 when this case started.”

The plaintiff’s lawyer is Lucy Mwai.
