Girl sues school, CS Jacob Kaimenyi over mini skirt

A secondary school girl who will be sitting for Form Four exam from Monday has sued her school after she was expelled for wearing a miniskirt. Sarafina Wanjiru has sued St Mary’s Mission Hospital School in Lang’ata saying she was unfairly kicked out of school after a disagreement with her teachers over wearing a school uniform that was considered short.

“The expulsion done two days to the examination was not done with the best interests of the child,” the court heard.

Through her lawyer Stephen Mwanza, she argued that the short dress the school complained of did not warrant for the kind of punishment rendered to her.

The 17-year-old girl told the court: “My Kiswahili teacher made it clear that she would punish me when I am about to sit for Kenya Certificate of Secondary Examination due to a personal grudge between us, which I cannot explain.”

In the case filed under a certificate of urgency before High Court judge Justice Mumbi Ngugi, the court heard that the actions by the school will affect her overall performance in the KCSE.

“Unless this court intervenes, the petitioner who is a minor, will continue to suffer irreparably due to the action by the school,” he said. The girl who has sued through her mother Elizabeth Muthoni and also named Education Cabinet Minister Jacob Kaimenyi, as the second respondent, said she was summoned by the deputy principal, but she was not accorded time to defend herself.

Wanjiru wants the court to compel the management to readmit her and also pay for the damages. Justice Ngugi certified the matter as urgent, and ordered that the respondents be served. The case will be mentioned next week.
