CJ Willy Mutunga confirms receiving bribery complaint against Justice Philip Tunoi

Nairobi: Chief Justice Willy Mutunga Monday confirmed he had received a complaint, in form of a sworn affidavit, alleging that Supreme Court Judge Philip Tunoi had received a bribe to influence judgement on Nairobi Governor Evans Kidero’s electoral victory.

“I received a complaint against a Supreme Court Judge by way of a sworn affidavit in November 2015. I ordered that thorough investigations be carried out according to our internal protocol,” said Mutunga in a statement.  

Mutunga said that investigations into the matter have since been carried out and he will be making a presentation on the same before a special sitting of the Judicial service Commission this week.

“From the Judiciary perspective, in view of the seniority of the  judge,  the  gravity  of  the  allegations,  and  the  public interest  this  matter  has  generated,  I  will  be  presenting this  matter  to  a  special  sitting  of  JSC  that  I  have summoned  for  Wednesday, January 27 at 10am,” said Mutunga.

In the affidavit by Journalist Geoffrey Kiplagat, it is alleged that Kidero gave Justice Tunoi $2 million (Sh200 million) to rule in his favour in the election petition by his rival Ferdinand Waititu.

Mutunga said that JSC will conduct its processes on the matter according to the law and the requisite due process.
