Bensouda: I have no evidence on President Uhuru Kenyatta

NAIROBI, KENYA: President Uhuru’s case at ICC is facing imminent collapse after Chief Prosecutor Fatou Bensouda admitted she has no evidence to sustain the President’s full trial.

Consequently, Ms Bensouda has applied to the Trial Chamber to adjourn Uhuru’s case that was slated to start February 5, 2014.

Bensouda told the trial judges that one of her star witnesses has been withdrawn after he admitted to have given false evidence to the Prosecution while a second witness withdrew.

FALSE EVIDENCE

The prosecutor has not given court a timeline within which to set a new date.

“In the last two months, one of the Prosecution’s key witnesses in the case against Uhuru has indicated that he is no longer willing to testify. More recently, on December 4, 2013, a second key witness in the case confessed to giving false evidence regarding a critical event in the Prosecution’s case. This witness has now been withdrawn from the Prosecution witness list,” she said.

The chief prosecutor says she has applied for the adjournment of the case to give her office more time to gather new evidence that can stand the threshold of trial
