Communications Authority of Kenya (CA) director general Francis Wangusi will continue to be in office after his contract lapses on August 22 this year.

Lady Justice Maureen Onyango today directed that he continues to be in office pending the hearing of an application by the Consumer Federation of Kenya (Cofek) seeking to stop the recruitment of the director general until CA has a board in place.

In the application, Cofec has named AG as the respondent and CA, PSC and Wangusi as interested parties want the court to stop the recruitment process of the director general pending the hearing of the said application.

They also want the matter to be heard on a priority basis to expedite the case.

In court documents, Cofec claims CA has purported to illegally conduct the recruitment of director general without a legitimate board contrary to the law.

"It's desirous and in the absolute public interest that this court intervenes to allow for an immediate stop to the unlawful purported recruitment of the successor to the current director," petitioners claim.

They urged the court to protect the public interest and the Constitution and specifically protect the interests of both the market and the consumer of ICT services.

They say the CA board is responsible for appointing, re-appointing, extending the contract and or terminating the contract of the director.
