Court orders Bungoma politician to pay Sh54,505 child upkeep every month

A Bungoma politician has been ordered to pay child upkeep after he separated from his wife.
Moses Nandalwe alias Mr Moneybags will pay Sh54,505 for upkeep of their child every month. Werre went to court demanding custody of the minor as well as financial support, arguing she is unemployed and solely depends on her husband.

In her affidavit, Werre claims Nandalwe forcefully kicked her out of their matrimonial home in Bisunu on November 17. As a result, she left behind their child under the care of a step-mother. Several attempts to re-unite with the minor have been in vain, she told the court in an application filed on January 25, 2021 by her lawyer, Mwaniki Gachoka and Advocates.

The woman told court, her husband is capable of paying the amount since he holds an influential position at Central Organization Trade Union (COTU) and is advisor to Tana River Governor Dhadho Godhana.
“It would be in the minor’s best interest and her welfare that the orders sought be issued,” she wrote.

Meanwhile, Nandalwe denies chasing away his wife, claiming she is stubborn and that she is being used by his political detractors. Nandalwe vied for the Sirisia parliamentary seat in 2017 narrowly losing to John Waluke. The politician is eying the seat in next year’s elections.

While ordering Nandalwe to pay for upkeep, Bungoma Principal Magistrate G. Omondi also ordered the minor be handed over to the mother for custody.

“I compel Nandalwe to pay the pleaded amount of money every 5th day of the month while Werre is in custody of the minor,” ordered Omondi on February 17.
