Warrant of arrest against PS lifted

The Employment and Labour Relations Court in Nakuru has lifted a warrant of arrest issued against Ministry of Environment Principal Secretary Ibrahim Mohammed.

The court lifted the order following an application filed by the Public Service Commission (PSC) on Wednesday.

The PSC, through State counsel Winnie Jebet, said Mr Ibrahim was not party to any suit and that the court had not issued any order directed to the commission.

In the application, the court heard that the PS was not in contempt of court and the orders issued on July 23 should be lifted.

The commission further said if the matter was not certified as urgent, the PS risked being arrested.

The court had ordered Inspector General of Police Hillary Mutyambai to execute the warrant of arrest and produce the PS on or before July 25.

Obey a court order

The PS had been accused of failing to obey a court order issued on July 8, where he had been summoned to state why he should not be committed to civil jail for disobeying a court decree dated April 7, 2017.

This was in relation to a case where Francis Waweru, a Ministry of Forestry and Wildlife staff, had sued PSC.

Mr Waweru, who was employed in 1987, had been interdicted in May 2011 through a letter from the director of Kenya Forest Service following allegations of involvement in illegal activities at work.

He sued PSC in 2016, claiming unfair and unprocedural dismissal from employment, and wrongful withholding of his salary.

In March 17, 2017, the court found that Waweru's dismissal was unfair and ordered his reinstatement without loss of any benefits effective May 11, 2011.

Justice Monica Mbaru granted stay orders and parties were given two weeks to address the matter of Waweru's reinstatement.
