CJ appoints bench for Kulei suit

Chief Justice Evan Gicheru has appointed a new bench to hear a suit by a former personal secretary of former President Moi.

On Monday, Gicheru said three judges, starting December 8 through 10, would hear the case by Mr Joshua Kulei.

The case was referred to the CJ following the elevation of Justice Joseph Nyamu to the Court of Appeal. Nyamu was hearing the case together with justices Matthew Emukule and Roselyn Wendoh.

Kulei has filed a constitutional suit challenging a directive by the Kenya Anti-Corruption Commission (KACC) that he declares his wealth.

KACC issued him with a notice saying he was reasonably suspected of corruption.

The applicant had finished arguing his case and KACC was responding to the suit, when President Kibaki elevated Justice Nyamu. Now, the case will have to start afresh.

Kulei is accusing the commission of violating his rights by demanding that he lays bare his wealth and how he acquired it.
