Residents on railway reserve to be evicted

The High Court has ordered Kibera and Mukuru kwa Njenga residents, who were not listed in a resettlement plan to move out of Kenya Railways Corporation railway line reserve of be evicted.

Justice George Odunga dismissed the case that had been filed by the residents challenging their eviction.

Odunga said the people who came after 2010, should vacate to allow for proper resettlement of those who had been listed.

However, the judge cautioned Kenya Railways that the eviction should be done in a humane manner.

Odunga noted that contrary to the case by the residents, the court was satisfied that the corporation had undertaken enough steps to ensure the people who had been living along the rail were resettled for their safety, adding that those who came between 2011 and 2012 were not entitled to remain at the place.

The judge directed the corporation to file a quarterly report in court on how the process is going on.
