New laws give police service fresh powers

The Commission for the Implementation of the Constitution is Monday set to meet the police employer for a briefing on the public's views on 18 regulations to mobilise police operations.

The public had sent their views opposing, approving and suggesting various changes to the proposed regulations.

Officials said Monday's meeting between CIC and the National Police Service Commission (NPSC) will be the final one before the drafts are sent to Parliament for approval and gazettement.

Among the regulations proposed include one that will grant the Inspector General of Police powers to promote junior police officers. Draft regulations by the commission propose that promotions from the rank of police constable to superintendent may be delegated to the Inspector General.

However, for promotions above superintendent, the NPSC will be responsible. "For avoidance of doubt, promotions of the ranks above superintendent shall not be delegated and shall be proposed by the IG and recommended to the commission in writing for determination," the regulations state.

Mandatory appraisals

Constitutionally, it is the NPSC that has all the powers to recruit, determine promotions and transfers within the police service. The regulations also introduce mandatory performance appraisals to establish a reliable track record of individual police officers for promotion.

"In order to assess whether an officer qualifies for a promotion, there shall be regular, mandatory performance appraisals in order to establish a reliable track record of individual members of the National Police Service," the draft says.

The regulations state that to be considered for transfer, an officer shall have served at a duty station continuously for at least one year and at most three years.

The draft says that any secondment of an officer shall be done after confirmation that the institution to which the officer is seconded shall pay the costs of the service of the seconded officer.

The document says an officer's notification of transfer shall disclose his new posting, the date of assumption of duties and details of the officer's facilitation of transfer.

Deployments of officers shall not be interpreted as transfers, it adds.

All deployment shall be for a period not exceeding three months and any further extension of the deployment period by the IG shall be with the approval of the Commission.

Governors will not have control and command of police in their regions even after the formation of the County Policing Authorities.
