Nairobi court compels Government to pay man over Sh1.7m for malicious arrest

NAIROBI: Principal Secretary Office of the President and the Attorney General have been compelled to pay Watson Munyori Njeru some of over Sh1.7 million over malicious arrest, detention in the year 2002.

According Njeru, he was awarded his withheld salary and other emoluments plus costs after the judgement was delivered on April 19, 2013.

Justice George Odunga while delivering the judgement on August 5, 2016 that having considered the material on record and in the absence of any impediment, he could not see the reason as to why Njeru should not be compensated.

"I do not see why the Principal Secretary should not be compelled to perform his statutory duty by setting the sums due from him to Njeru," said Odunga.

He ordered Njeru to be paid Sh753,870.00 which is the principal sum as per the decree with interests from June 6, 2002 at 12 percent annum till payment in full with costs assessed at Sh113, 937.00.

According to Njeru, he filed the said Civil Suit after the Principal Secretary and the Attorney General failed to provide the funds for the settlement of the same yet they are under a public duty to do so.

In support of his case Njeru exhibited copies of the judgement, decree, certificate of costs letter to the Attorney General demanding settlement and letter from the Attorney.

Despite having been served the respondents did not oppose the instant application.
