Kabete Ferdinand MP Waititu wants poll dispute case reviewed

Kabete MP Ferdinand Waititu wants a review of the Supreme Court ruling that handed Evans Kidero the Nairobi gubernatorial seat arguing that he is the rightful owner of the seat.

Mr Waititu said he will move back to the Supreme Court to have the case looked at afresh, a day after allegations emerged that Justice Philip Tunoi had received a bribe of Sh200 million to rule in Kidero's favour.

Through his lawyer, Harrison Kinyanjui, Waititu claimed he had been robbed of the seat and that justice had not been done in the election petition. "If these allegations are true, their emergence vindicates the veracity of our case," said Waititu.

" ... It follows that the judgment in favour of the governor must be set aside. The revelations cast grave doubt on the credibility of the entire justice system because the judge is sitting at the apex of the Judiciary and is, therefore, a symbol of what is endemic corruption in the Judiciary," he alleged.

Mr Kinyanjui said Waititu has written to Chief Justice Willy Mutunga asking for a copy of the report on investigations into the allegations against Justice Tunoi.

He also wants Kidero's lawyer, Tom Ojienda, to recuse himself from the Judicial Service Commission on which he sits as a representative of the Law Society of Kenya, arguing that he will not be impartial in considering the allegations levelled against Tunoi.

"The person who made the claims is either a mad person or this person is honest, bold, and laying the bare facts on the table," said Kinyanjui.
