DPP opposes release of Githurai police officer

NAIROBI, KENYA: The Director of Public Prosecutions (DPP) and the Independent Policing Oversight Authority (IPOA) are opposed to the release of a police officer whose prosecution on murder charges has sparked riots in Nairobi.

Titus Ngamau Musila alias Katitu (above) was arrested and charged with the murder of two people, which has seen Githurai 45 residents take to the streets in protest.

Wednesday, IPOA investigator Diana Watila, in a replying affidavit, opposed the release of Musila, saying he would interfere with investigations by threatening witnesses.

In the course of being investigated for the death of Kenneth Kimani Mwangi, she said the accused threatened to kill his brother Oscar Muchoki Mwangi.

Watila said Musila continues to threaten other witnesses who have recorded statements regarding the case.

Musila is represented by six law firms led by lawyer Cliff Ombeta, who have been retained by Nairobi Senator Mike Sonko.

Mr Ombeta, in a certificate of urgency, argued that Musila should be released on bail as murder is a bailable offence under the Constitution.

High Court judge Roselyn Korir said she would hear the bail application tomorrow morning.

On September 5, Musila denied killing two people and has since been in remand at the Industrial Area Prison pending the bail hearing.
