Judge Odunga to sentence Boinett, Matiang'i and Kihalangwa for defying court orders

Justice George Odunga is set to sentence Interior Cabinet Secretary Fred Matiang’i, Immigration boss Gordon Kihalangwa and Inspector-General of Police Joseph Boinnet for defying court orders.

The three officials failed to appear in court on Wednesday 28 March for the hearing of National Resistance Movement (NRM) General Miguna Miguna who had been detained at the Jomo Kenyatta International Airport (JKIA) since Monday 26 March.

“The said respondents must personally appear before this court at 10am for sentencing and further orders. In default of their appearance the court will proceed to mete out appropriate sentences, their absence notwithstanding,” ruled Justice Odunga.

Justice Odunga said that he will not allow the three government officials to walk around disobeying court orders as no one is above the law.

“There is no immunity for impunity; a time has come when the courts must lift the veil against those who act with impunity in disobeying it. No man is above the law. The Government officials cannot be allowed to catwalk around while disobeying court orders,” said Odunga.

Despite Justice Odunga orders not to remove Miguna out of the country, the NRM General was deported on Wednesday night to Dubai. Miguna says he was drugged after forcefully flown out of the country.

“Under no circumstances should Miguna Miguna be removed from the country and must be presented in this court today at 10am. His lawyers must also be given unrestricted access to where he is being detained at the airport,” said Odunga.
