Why Nakuru businessman wants to throw away 18 years of marriage

 A Nakuru Asian businessman is seeking to divorce his wife because she has become physically and emotionally violent. The man wants their marriage to be dissolved, a divorce a decree issued and his wife to pay the cost of the divorce suit.

In his papers, he claims that they solemnized their marriage on July 21, 2002 under the Hindu marriage and divorce act, (now repealed), at the Shree Visa Oshwal Community Temple in Nakuru.

“The petitioner and the respondent cohabited as husband and wife at Raj Courts Milimani Nakuru and Section 58 and were blessed with one child on February 20, 2006,” reads the petition.

He, however, claims that their marriage has irretrievably broken down after his wife started to physically assault him and perennially occasioning him verbal abuse. He accused her of theft and continuous misuse of the family money for her own selfish gain.

“The respondent has stealthily accessed the family gold chains from a bank safe deposit box and never accounted for the same. Whenever asked, she would get violent,” reads the petition.

He adds that she is intemperate person of violent disposition and has made the couple become wholly incompatible.
The man claims his wife has refused to get a job and she prefers lazing around.

“The respondent prefers to idle around waiting for the petitioner to arrive home in the evening to pick a quarrel.”
He claims the woman has become a stalker and constantly follows him at his place of business to pick a quarrel with him and his friends and customers.

He states that all attempts at reconciliation have failed, forcing him to move out of the matrimonial home.
But in her response, his accused him of neglect to the point of even forgetting their daughter’s name, “The petitioner filed his daughter’s name wrongly in his papers.”

She denies all allegations and instead accuses her husband of assaulting several times in front of their child.
 “He would occasion the respondent beatings in presence of house help, seeking to humiliate her,” she says, adding that she has suffered permanent injuries, both to her leg and at the back of her head.

At one point, she avers, her child who attempted to save her from her beatings, ended up in hospital for medical attention due to injuries sustained. She denies verbally abusing her husband despite taunts about her weight and all forms of allegations lodged against her and her birth family.

She admits selling the gold to supplement part of the household budget as they were in hardship.
“Part of the gold were respondent’s; she came with them at the time of their marriage. Any other gold went with the sister to the petitioner,” states her documents.

She claims that her husband wants to mentally and physically break her over the gold issue despite solving it in 2007 and also accuses him of infidelity.
 “If the petitioner stops his adulterous ways and his verbal abuses and physical assault, both him and the respondent could live happily as a family.”

She adds that they were a happy family until her husband started becoming unfaithful and had an affair with two different women in the last three years. She however claims that her husband is welcomed back to the matrimonial home as she believes that the marriage can be salvaged.

“The respondent is a very calm person and she believes that they are compatible in marriage,” she says.
