Incest: Rongo man sentenced to life for defiling niece

A court in Migori has sentenced a man to life in prison for defiling his 11-year-old niece.

Lameck Ochieng was accused of committing the act on December 13, 2020 at Kameji area in Rongo Sub-County in Migori County.

On Wednesday, Principal Magistrate Raymond Langat ruled that the prosecution had proved the case against him beyond reasonable doubt.

"The main count of defilement was proved to the required standard. Although the accused person mitigates that he has a young family, the offense in question is grave and he deserves no mercy," said Langat.

Ochieng however, denied the accusations claiming he was innocent.

But five suspects who testified against him during the course of the proceedings implicated him to the offense.

A medical report that was also presented in court indicated that the minor was defiled.

Ochieng had been accused of defilement and was facing an alternative charge of committing an indecent act with a minor.

During the course of proceedings, the court heard how the suspect lured the minor to a maize plantation and defiled her. The suspect also allegedly threatened the victim after committing the act.

However, when the minor who was in pain got home, she disclosed to her mother what had happened to her and the mother immediately went and reported the incident to the area assistant chief.

The minor then led her mother and the assistant chief to the maize plantation where she was defiled before the family reported the matter to police.

She was examined on the same day with medical reports indicating that she was defiled.

During the delivery of his judgement, Ochieng asked the court to show him leniency and claimed that he is an orphan.

In his judgment, Langat said the minor suffered untold trauma in the hands of the uncle and will live with that trauma for the rest of her life.

"Considering all those and the penalty prescribed under the sexual offense acts, and to be an example to the would-be offenders and being that this is an offense that is rampant in this area, and there is need for deterrent, I sentence the accused to life imprisonment," Langat said.
