Pending election petitions to proceed regardless of rifts at IEBC

All the ongoing election petitions will proceed to their logical conclusions regardless of the rifts at the Independent Electoral and Boundaries Commission (IEBC), a group of lawyers has said.

The lawyers said the cases would only be affected if the President, the appointing authority of the commission chairman, was no longer in office.

Kamotho Waiganjo, CN Kihara and Paul Nyamodi were responding to a media inquiry on whether the active election petitions would proceed given the resignations of three IEBC commissioners last week. 

The three lawyers said if the entire commission were to resign there would still be no hitch as long as the President’s office was not vacant.
