Ex-MCA loses bid to declare Dr Kuti unfit for office

A former MCA has lost a petition at the High Court to have Governor Mohamed Kuti (pictured) declared unfit to hold office on a number of grounds including nepotism in hiring top county officers and abdication of duty. 

Moses Kithinji, formerly of Bullapesa ward, had asked Justice Francis Gikonyo to declare that Dr Kuti had abdicated and neglected his duties as governor. 

But the judge declined saying there were relevant national organs established to interrogate the allegations and take necessary action. 

“I must commend the petitioner for raising valid queries and he is admirably a whistleblower of alleged offences of corruption but it would do justice if these complaints are lodged with the relevant bodies for investigations and appropriate action,” said Justice Gikonyo. 

The judge said if the court was to probe the claims, it would not only be interfering in a mandate it lacked but also threatening harmony of state organs. 

Kithinji said he was happy that the court had recognised his whistleblowing role and will be taking up the advice of the High Court to report the allegations to the EACC.
