Court of Appeal: Matemu Mumo can assume office as Ethics and Anti-corruption Commission boss

NAIROBI, KENYA: Court of appeal has quashed earlier ruling barring Mumo Matemu from assuming office as the director of Ethics and Anti-corruption Commission (EACC).

The court noted that High Court while ruling on the suitability of Mumo to assume the office as EACC boss usurped the powers of parliament.

“The  High Court cannot usurp the powers of parliament,” said the court.

High court nullified Matemu’s appointment and said President Kibaki, Prime Minister Raila Odinga and Parliament ignored concerns raised about Matemu’s suitability for the office.

The bench appointed by Chief Justice Willy Mutunga said the Executive and MPs failed to investigate Matemu’s integrity and competence and opted for political expediency to push his name through.
