High court orders detention of 16 containers over Sh71m debt

The High Court has ordered authorities to detain 16 containers belonging to a Ugandan company over a Sh71 million debt owed to a cargo clearance firm in Kenya.

Logistic Link Limited through their lawyer Daniel Ngonze told Justice P.J. Otieno that Prime Concept Packaging Limited had declined to pay them Sh71,582.000 incurred in clearing their cargo over three months.

Mr Ngonze told Justice Otieno that Prime Concepts had declined to pay Logistic Link the money despite admitting to liability and loss of business.

“Unless the court grants the orders as prayed by Logistic Link with urgency, Prime Concept shall, in all likelihood, remove the consignment from this honourable court’s Jurisdiction, to the plaintiff’s obvious, grave and irreversible prejudice and detriment, net resultant loss, injury and damage would be too onerous to be remedied in anyway, manner or form,” he said.

According to Logistic Link branch manager Johannes Mwanyota, they had entered into a contract with Prime Concept to clear goods at the port and offer transport services.

“Pending the hearing and determination of this application, the honorable court be and is hereby pleased to grant leave to the plaintiff to attach and detain the defendant’s consignment currently awaiting clearance at the Port of Mombasa,” Justice Otieno said.
