Employees who aren’t entitled to service pay

Section 35 of the Employment Act, 2007, says an employee who resigns or his services are terminated legally is not entitled to service pay if he is a member of a registered pension scheme, gratuity or service pay or any other scheme operated by the employer. In Kenya, most employees are registered with the NSSF. Does that mean in case of resignation or termination employees will only take home their salaries and leave arrears?
