Court orders kin of Kisii County worker be paid Sh5 million

Kisii County has been ordered by a Nyamira Court to pay the family of one of its drivers who died in a road accident Sh5.3 million as compensation.

Evans Moya Moindi was driving the vehicle belonging to the County Government on January 1, 2016, on the Kisii–Nyamira Road at Omogonchoro area when the fatal accident occurred.

Jackson Moindi Ontegi, the father to Moya, acting as the legal representative and administrator of the estate, had sued Kisii County Government and Kisii Governor James Ongwae for damages following his son's death.

“My son, who died at 32 years of age while on duty, was earning a monthly salary of Sh23,000 and would have retired at the age of 60. My family was solely dependent on him for upkeep,” Ontegi told the Court.

Nyamira Chief Magistrate Margaret Wambani said evidence adduced in court had proved that the defendants in the case were wholly to blame for the accident. She ordered them to pay Moya's family a total of Sh5.3 million.

Ms Wambani said the family would cumulatively receive an equivalent of the salary Moya could have earned for the 28 years he could have been on duty until retirement with the court applying a two-thirds dependency ratio in total it would have been Sh5.1 million.
