Lawyer Kioko Kilukumi, Cecil Miller and businessman Humphrey Kariuki.

Prosecutors in Sh41 billion tax evasion case against businessman Humphrey Kariuki have been granted 21 days to furnish the defense with all witness documents and statements.

This is after the parties appeared before Senior Principal Magistrate Martha Mutuku on Thursday and prosecution said that they require 21 more days to enable them to compile and supply witness statements to the defense.

“I request the court to allow us more days so that we can supply witness statements to the defense and other relevant documents to be used in the case,” said Assistant Director of Public Prosecutions Vincent Monda.

At the same time, Monda told the court that the documents sought are in large volumes.

He said they had supplied some statements to Kariuki but admitted there are more documents that need to be provided.

Defense lawyers, on the other hand, said they wanted the prosecution to supply all the witness statements and other documents by September 20 and not on 26 when the cases will be mentioned.

Lawyers Kioko Kilukumi and Cecil Miller who are representing Kariuki said they were supplied with 27 witness statements on September 4 and 23 exhibits, which was very late.

Magistrate Mutuku ruled prosecution has until September 20 to give the documents.

The parties to appear in court on September 26 for mention.
