Teenager gets life in prison for incest

A teenager will serve life imprisonment for sexually assaulting his 12-year-old sister.

Senior Resident Magistrate Yvonne Khatambi said a deterrent sentence was mandatory for the offence.

“The incident has been rampant in this area of jurisdiction. The accused will serve as a lesson to others with same ill intentions,” said Ms Khatambi.

The teenager was on January 22 found guilty of incest by sexually abusing his sister.

The accused committed the offence on April 7, 2018, at their home in Heshima within Nakuru.

The police said the accused arrived at his mother’s house at 1pm and demanded food from his three siblings.

They allegedly informed him that there was no food and he began beating them up.

“He directed his two siblings to go to the next room and took the complainant to his mother’s room. He physically assaulted her, tied her mouth with a piece of cloth and went ahead to defile her on his mother’s bed,” read the report.

The matter was reported to Bahati Police Station. The accused was apprehended and charged but denied having sexual relations with his sister.

Five witnesses testified against the accused, including his mother, the complainant and two siblings.

Medical report showed that the complainant had a broken hymen.

In his defence, the accused claimed that his family framed him for the offence because he had differences with his mother.

“I demanded to know who my real father was from my mother. She had refused to respond to the question,” he said.

He also added that he had been chased away from home since 2013 and he only came back in 2017.

The court overruled his paternal issue since he did not raise the issue when cross-examining his mother.

He has 14 days to appeal.
