Relentless Karua moves to Supreme Court to challenge Waiguru election

Narc Kenya party leader Martha Karua has taken her battle to unseat Kirinyaga Governor Anne Waiguru to the Supreme Court.

Through a notice of appeal filed at the Court of Appeal registry in Nyeri, Ms Karua (right) indicated that she was dissatisfied by the decision to uphold Ms Waiguru’s win.

The notice filed through lawyer Gitobu Imanyara is dated December 28 and was received at the registry on December 31, 2018.

Justices Roselyn Nambuye, Hannah Okwengu and Gatembu Kairu on December 20, 2018 upheld Waiguru’s election. Karua is seeking nullification of Waiguru’s election on grounds that the August 8, 2017 poll was not free and fair.

She claimed that the election was marred by voter bribery and that her agents were barred from accessing the polling stations.

In her petition to the appellate court, Karua protested the ruling by the appellate court in Kerugoya, saying it was not fair.

While upholding Waiguru's election, the appeal court said Karua had failed to convince the court she suffered prejudice when the Independent Electoral and Boundaries Commission failed to produce the Kenya Integrated Election Management System (Kims) kit.

After the judgement, Karua said she would appeal the judgement at the Supreme Court. “Appeal dismissed with no order as to costs. I am headed to the Supreme Court to exhaust the justice chain,” Karua said on Twitter. The judges ordered each party to bear their costs.

On November 15 last year, the High Court in Kerugoya twice dismissed Karua’s case.
