Raila: Sworn affidavits indicate IEBC figures not tallying

Affidavits filed to support Raila Odinga's presidential election petition cite glaring discrepancies in the final figures announced by the Independent Electoral and Boundaries Commission (IEBC).

The figures from various polling stations and constituencies as indicated in Forms 34As and 34Bs do not tally with the results announced by IEBC Chairman Wafula Chebukati that declared Uhuru Kenyatta the winner.

In various affidavits sworn to support National Super Alliance (NASA) presidential candidate's petition at the Supreme Court, individuals have alleged several inconsistencies with the final tally.

Kenya Human Rights Commission (KHRC) Executive Director George Kegoro claims that on Election Day, Kura Yangu Sauti Yangu (KYSY), a coalition of civil society organisations in Kenya, deployed over 500 monitors in all the 290 constituencies to monitor and observe the election.

"The final results verbally announced by IEBC Chairman Wafula Chebukati on 11 August are dramatically contradicted by the data displayed on the website portal," reads part of Kegoro's affidavit.

Mombasa County Government Economic Adviser Nyangasi Oduwo was tasked by the petitioner to examine 5,000 Form 34As supplied by presiding officers, and to compare the same with the Form 34Bs supplied by IEBC and Form 34As posted on the commission's website.

Dr Oduwo, in his sworn affidavit, says in Igembe South, Meru County, the summation of votes in Forms 34As is 41,834 and yet, according to Form 34B in the commission's portal, the total votes for Uhuru Kenyatta is 43,209 which means there were some 1,375 votes more.

"Form 34A in respect of Rabai Road Primary School Polling Station Number 1 of 4, Harambee Ward, Makadara Constituency, and Nairobi County indicates that the total number of valid votes cast is 482 with Uhuru Kenyatta is 133 as against Form 34B in the commission's portal, which indicates that Kenyatta has 587 votes and the total valid votes cast are 1,873. This means that the votes cast surpassed the total number of registered voters in the polling station," reads the affidavit.

Upon scrutinising Forms 34As on the IEBC portal, he found a number had no names or signatures of party agents and without reasons from presiding officers, some were signed by ungazetted presiding officers while others were from ungazetted polling stations.
