Senate sued over county boards

Three petitioners have moved to court seeking orders to bar senators from chairing the county development boards.

Nyukuri Barasa, Phillip Wanyonyi and Nancy Wamalwa of Bungoma County have accused the senators of usurping governors' powers if they are allowed to chair the boards. 

They also argue that the Senate contradicted the Constitution by creating the boards. In a sworn affidavit, the trio want the High Court to declare the changes made to the County Government Act 2013 unconstitutional and also have senators barred from chairing the boards before the matter is determined.

Gross violation

The petitioners also want the High Court to declare the County Government Amendment Act 2013 unconstitutional and illegal.

"By creating the county boards, the senators went against the law and we want them prosecuted for gross violation of the Constitution and abuse of the rule of law," said Mr Barasa.

They also want the High Court to direct the Senate and the National Assembly to review and delete some sections/provisions of the County Government Amendment Act 2013.
