PSC enjoined in case against speakers

Nairobi, Kenya: The Parliamentary Service Commission (PSC) has been enjoined in a case where National Assembly Speaker Justin Muturi and his Senate counterpart Ekwe Ethuro are accused of abuse of office.

Activist Okiya Omtatah asked the High Court to decipher the alleged claims that Muturi and Ethuro have disobeyed court orders in various accounts.

Justice Isaac Lenaola admitted the PSC into the case after the commission made an oral application before him. The commission’s lawyer, Nderitu Njoroge, asked the court to admit them in the case as an interested party.

In spite of an application by the Judicial Service Commission also to be enjoined, Justice Lenaola did not allow the application. 

Candid advice

He addressed the lawyer of Parliamentary Service Commission off record that they ought to pass his candid advice for them to make appearance and respond to the case before the court.

“Kindly ask them to make responses and assist the court by obeying the court proceedings and orders,” Justice Lenaola said off record.

He said JSC cannot add any value to the case as a five-judge bench has since been set to hear the case where the court has been asked to interpret if Parliament has powers to summon the commission.

“The bench is sufficient to determine the JSC-Parliament row and shed light to the separation of powers between the three arms of Government,” said Lenaola while dismissing the application.
