Two court clerks, narcotics suspect charged with theft of 62 million title deeds

Two Malindi court clerks have been charged with stealing three title deeds from the court and presenting them as security in a Mombasa one.

Roba Jarsen Jara and Driscilah Wanjala are accused of stealing the title deeds worth more than Sh62 million from the Malindi law courts to use them to free a suspected criminal in a separate trial at the Mombasa law courts.

They are charged alongside Swaleh Yussuf Ahmed, the suspect, who is accused of trafficking in narcotics worth Sh300 million.

Yussuf is facing four drug-related charges in Malindi and Mombasa.

According to prosecution, the title deeds had been deposited at the Malindi law courts to secure Yussuf's freedom in the Malindi trial, but the two clerks stole them to secure his freedom when he was arrested again and charged in Mombasa.

Trafficked 91,738g

Yussuf and his wife Asma Abdalla Mohamed were charged on February 13, 2017 that jointly with others not before court, they trafficked 91,738g of heroin valued at Sh275,214,000. He was released on a Sh25 million bond.

The two clerks are accused of stealing the title deeds, despite the same having been presented as surety in the Malindi court.

They are accused of attempting to present the three title deeds in Mombasa law courts to use them to execute another surety in the other case before the court.

The two are alleged to have colluded with Anthony Chai Baya, who is yet to be arrested, to secure and execute bond for Yussuf, who is detained at the Shimo La Tewa Prison over the drug trafficking charges.

Yussuf and the two clerks appeared before Senior Resident Edgar Kagoni and were each released on Sh500,000 bond, with an alternative cash bail of Sh100,000
