A good number of Jubilee MPs and Senators have come out to dismiss the presidential elections petition filed on Friday by the NASA coalition legal team at the Supreme Court to an extent that they have declared that they will overthrow the matter in court.
The Jubilee politicians have treated the case by NASA with disregard saying the volumes of work to be served to the court lack serious grounds for which the re-election of their party leader can be nullified.
Those leading the onslaught include Senators elect Kithure Kindiki, Kipchumba Murkomen and National assembly majority leader Aden Duale.
Kindiki, who is a lawyer claims to have gone through the petition keenly and observes that it is the weakest he had come across yet it is seeking to challenge the election of a president while Murkomen terms it as hopeless and can only de3srcibe it better as one intending to intimidate the Supreme court.
An earlier claim by NASA that the IEBC servers had been hacked to facilitate the manipulation of the polls outcome, the Jubilee legislators say is missing in the petition as they realized that NASA had completely abandoned the grievance.
However, seemingly other complaints the politicians appear to be taking no notice of have been raised by NASA. The petitioner claims that there were returning and presiding officers ungazetted but signed form 34Bs.
They could be a major strength for the opposition in the case as they also claimed to have evidence on how details of the slain IEBC manager for ICT were used to access the election management system.
NASA also has raised a red flag over alleged tallying of results from non-existent polling stations and blames the commission of gross undermine of the law by following contradictory and inconsistent operational procedures.
The petitions also cites flaws in the rejected votes as they realise serious discrepancies in their tally in addition to the relaying and transmission of results which they argue was not simple, accurate, verifiable, secure, transparent and as required by law.
Aden Duale, who served as the National Assembly majority leader and defended the ruling party’s agenda at all costs seems to be ready to take on the opposition with much more effort this time round. He feels having a super majority in the house already has given him an easier job should he be retained in the office.
Jubilee party secretary general Raphael Tuju clearly is relaxed despite the petition as he finds it difficult for the opposition to convince anyone that they had won the elections with a popular vote but performed dismally in other elective positions.
Jubilee captured majority seats in both parliament houses and has more governors on its side from the outcome of the August 8 elections.
