Nicola Traldi defense team demands repeat medical exam for Chantal, claims documents don't show broken leg

Nicola Traldi has through his lawyer asked the court to allow a second medical examination of his ex-girlfriend Chantal Grazioli, following claims that he assaulted her and broke her left leg. Chantal, who is also Eric Omondi’s ex, reported the assault at Kiambu Police Station under OB NO 5/17/6/22 and recorded a police statement saying the businessman attacked her with a rungu that left her leg broken.

Speaking to The Nairobian, Oscar Ogilo of Odindo & Company advocate said, “My client was charged with grievous harm and the charges were that he allegedly assaulted Miss Chantal. We came back for a pretrial. That's when we were given the charge sheet and other prosecution documents, and that’s when we started smelling a rat because from the nature of the injuries captured, they were all soft tissues.

However, the nature of the injuries as per the charge sheet was of a broken left leg so we have now come back seeking directions of court to have Chantal compelled to go for a second medical examination. That has not been easy, it seems like they're avoiding that for obvious reasons."

Ogilo pointed out that the defence is in possesion of three medical reports, none of which show the leg injury: "We have three medical reports. The P3 form, one from the GBV Centre at Nairobi Women's Hospital, and from St Teresa's hospital. All these documents are aligned to the fact that she had soft tissue injuries. However, the charge sheet read something totally different: it talks of a broken left leg and that raises the charge from assault to grievous harm. And you know grievous harm carries a maximum sentence of life imprisonment. So that is a game changer.”

On June 19, Chantal accused her boyfriend of physically assaulting her on several occasions. Speaking on her Instagram page, Chantal said Nicola came home drunk, broke into the house and assaulted her, “This is to bring to the public limelight that Nicola Traldi came drunk, agitated and broke into my house Friday 17th morning since I had refused to let him in as I didn't want any confrontations with him while drunk. He assaulted me really badly and pushed me down the stairs as you saw from the video that was posted by @ericomondi. The photos posted as well are from previous assaults, it being not the 1st, the 2nd, the 3rd and unaccountable times that Nicola has assaulted and threatened me.”

She revealed this was not the first time, “On numerous occasions he has asked me to shun away from the media which I did due to fear of being humiliated and assaulted. I was afraid to come out but on Friday being the worst, I reached out to my mum to no avail, in the meantime my neighbours, security and caretaker came to my rescue. I reached out to Eric who was able to come through and assisted me from there henceforth and also came out to the public on my behalf.”

Chantal said she has reported the matter to the police, “We followed all the protocols that were required from us by the police and hospital ( both private and public) but until now Nicola has not been arrested and he took my sim card, my phone, car keys and my house keys. While he was assaulting me, he threatened me that he would come back and do it again and there was nothing I would do because he knows the big people.

This puts my life in danger since I have no idea what he will do next. If he claims that he is being framed why can he not present himself at the police station, he is not reachable either. It is traumatizing and not easy for me physically and emotionally, nor is it not easy for any form of GBV victims irrespective of who is involved and especially those who cannot come out and speak about it. Majority are helplessly dying in silence. It is very very sad that GBV is not taken seriously in this country.”

In his defence, Nicola said he has been framed, “Everyone who knows me knows I am incapable of such a thing my mum taught me well. I would never lay my hands on a lady. I am a father of 2 daughters, the truth shall come out. I have been framed for something I would never do, unspeakable. It’s a sad day.”
